Please read these Terms and Conditions ("Terms") carefully before using the Waterform Pools website (the "Site") or engaging our services. By accessing the Site or contacting us about our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Waterform Pools ("Company," "we," "us," or "our"), a luxury pool design and construction company based in Phoenix, Arizona. Your continued use of the Site constitutes your ongoing acceptance of these Terms, which we may update from time to time.
2. Use of the Website
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. You may not:

3. Services and Project Agreements
The information provided on this Site is for general informational purposes only and does not constitute a binding offer or contract for services. All projects require a separate written agreement between Waterform Pools and the client, which will govern the specific scope of work, pricing, payment schedule, timeline, and other terms applicable to that engagement.
Submission of a contact form or inquiry does not create a contractual obligation on the part of Waterform Pools to provide services. We reserve the right to accept or decline any project inquiry at our sole discretion.
4. Estimates and Pricing
Any project estimates, pricing ranges, or timelines communicated via the Site, email, or telephone are preliminary and non-binding until confirmed in a signed written agreement. Final pricing is subject to site assessment, design specifications, material selections, permitting requirements, and other factors specific to each project.
5. Intellectual Property
All content on the Site — including but not limited to text, photographs, graphics, logos, videos, design elements, and the Waterform Pools name and brand — is the exclusive property of Waterform Pools or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent, except for personal, non-commercial use.
6. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WATERFORM POOLS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We make no warranty or representation regarding the accuracy, completeness, reliability, or suitability of any information on the Site. Any reliance you place on such information is strictly at your own risk.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WATERFORM POOLS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you for all claims arising from the use of the Site exceed one hundred dollars ($100.00).
8. Indemnification
You agree to defend, indemnify, and hold harmless Waterform Pools and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
9. Third-Party Links
The Site may contain links to third-party websites or resources for your convenience. We have no control over the content, privacy policies, or practices of third-party sites and accept no responsibility for them. Linking to a third-party site does not imply endorsement by Waterform Pools.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
11. Dispute Resolution
Before initiating any formal legal proceeding, you agree to first contact us in writing to describe the dispute and allow us a reasonable opportunity — no less than thirty (30) days — to resolve the matter. Nothing in this section limits either party's right to seek injunctive or other equitable relief where appropriate.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waterform Pools with respect to your use of the Site and supersede all prior agreements, representations, and understandings relating to the same subject matter.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. The effective date at the top of this page will be updated accordingly. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
